Trademarks in Eurasia
In the Eurasian region, a trademark can be protected either through a national application or via the international Madrid System. A national application is filed with the patent and trademark office of each country through a local registered attorney. In contrast, an international application allows protection in multiple countries with a single filing. A trademark can consist of a word mark, a figurative mark, a slogan, or a combination of these. Three-dimensional marks, sound marks, and packaging designs can also be registered. Trademarks can be registered in either Latin or Cyrillic script; however, it is essential to note that a mark registered in Latin script does not protect the corresponding mark in Cyrillic, and vice versa.
The registration process typically takes 1–2 years, and a registered trademark is valid for ten years. It can be renewed for subsequent ten-year periods, and the trademark owner has the exclusive right to use the mark and to prevent others from using it. The mark must be used according to the local requirements; otherwise, a cancellation action may be filed on the grounds of non-use. Strict standards apply for proving use, and evidence such as customs documents, resale agreements, or invoices may need to be provided.
Trademark protection in all Eurasian region countries generally follows the same process, with minor country-specific variations. In the national registration process, a separate application must be filed in each country.
Eurasian Trademark System
A common Eurasian trademark system is being planned among the member states of the Eurasian Economic Union (EAEU) – Armenia, Belarus, Kazakhstan, Kyrgyzstan, and Russia. The system aims to simplify and harmonize trademark registration and protection across the region by offering a unified application procedure with a single filing, allowing for cost-effective protection in multiple member states. The system is currently in the planning and preparation phase, and timelines for implementation will be clarified at a later stage.
